Questions
How much can a landlord charge for late rent?
It depends on the state. Some states cap late fees and others only require them to be reasonable and written in the lease. Florida has no statutory cap for residential leases.
What is a typical late fee?
A flat fee or 5% to 10% of the monthly rent is common, sometimes followed by a small daily fee up to a cap.
When does a late fee start?
After the grace period in the lease. With rent due on the 1st and a 3-day grace period, the fee applies if rent isn't paid by the end of the 4th.
Should late fees have a cap?
A cap keeps a daily fee from growing past what a court would see as reasonable. Many leases cap total late fees at a percentage of the rent.
Put the terms in writing
A late fee only holds up if the lease states it: the grace period, the amount and any daily fee or cap. Moving a tenant in mid-month? Use the prorated rent calculator.
