Summary. DailyBuilt, Inc. sends text messages on behalf of the businesses that use its platform. If you gave your mobile number to one of those businesses, this page explains what you agreed to receive, how often, and how to stop. Message and data rates may apply. Message frequency varies. Reply STOP to stop. Reply HELP for help.
1. Who sends these messages
1.1 DailyBuilt, Inc., a Delaware corporation ("DailyBuilt", "we", "us"), operates a business software platform. Businesses use it to take bookings, send documents, request payment, and communicate with the people they serve.
1.2 Text messages sent through this program are sent by DailyBuilt on behalf of a specific business you interacted with (the "Business"). The Business is named in the message. The Business decides what messages go out and to whom; DailyBuilt provides the software and delivery.
1.3 Your relationship for the underlying appointment, document, invoice, or service is with the Business, not with DailyBuilt.
2. What messages you may receive
2.1 Transactional messages
These are messages about something you asked for or are already involved in. They include:
- booking confirmations;
- appointment reminders;
- schedule changes, reschedules, and cancellations;
- replies from the Business to a request or inquiry you sent;
- notices about a document sent to you for signature; and
- notices about an invoice or payment request.
How you consent: by giving your mobile number to the Business, or by entering it on a DailyBuilt-hosted booking, inquiry, signing, or payment page, after being shown a notice like the one on this page. Providing your mobile number is optional and is never required in order to book, sign, or pay.
2.2 Marketing messages
These are messages that promote the Business, its offers, its services, or its events.
DailyBuilt does not currently operate a marketing text-message program on the sending number used for the messages described on this page. That number carries only the transactional and customer-care messages described in Section 2.1.
If DailyBuilt makes a marketing tier available in the future, it will run on a separately registered number and campaign, and a Business may use it only where the Business has captured your prior express written consent meeting 47 C.F.R. § 64.1200(f)(9). That means you were shown a clear and conspicuous disclosure and you affirmatively agreed, in writing or by a compliant electronic signature, to receive marketing texts at the number you provided.
Marketing messages would never be a condition of purchase. You are not required to agree to receive marketing texts in order to book an appointment, sign a document, pay an invoice, or receive any product or service. Declining marketing texts does not affect the transactional messages in Section 2.1, and it does not affect the service you receive from the Business.
You will not receive marketing texts unless the Business captured that consent from you. If you receive a marketing text you did not agree to, reply STOP and tell us at hello@dailybuilt.co so we can investigate.
3. Message frequency
Message frequency varies. It depends on your activity with the Business: how many appointments you book, how many times an appointment changes, how many documents or invoices you are sent, and how much back-and-forth your requests involve. There is no fixed number of messages per month or per week.
4. Cost
Message and data rates may apply. DailyBuilt and the Business do not charge you for these messages, but your wireless carrier may charge you for sending or receiving text messages, depending on your plan. Check with your carrier if you are unsure.
5. How to stop messages
5.1 Reply STOP to any message in the program to stop receiving messages from that program. The following keywords are also honored:
STOP · STOPALL · UNSUBSCRIBE · CANCEL · END · QUIT
5.2 After you send an opt-out keyword, you will receive one final message confirming that you have been unsubscribed. After that confirmation, no further messages will be sent to you from that program.
5.3 You do not need to explain yourself, call anyone, log in anywhere, or take any other step. Opt-out is free.
5.4 Your opt-out is processed by your wireless carrier and by our messaging provider, and it is recorded so that the Business's later messages will not go to your number.
5.5 Most messages are sent from a phone number DailyBuilt operates and shares across the businesses that use it. If you reply STOP to a message from that number, your opt-out applies to that number, which means you will stop receiving messages from every business that sends from it. A Business that uses its own dedicated number is separate; opt out of that number separately. DailyBuilt also records the opt-out on its own systems, and an opt-out recorded for a shared sending number is applied across the platform, so no Business sending from that number can text you again.
5.6 If a marketing tier becomes available under Section 2.2 and you opted in to both transactional and marketing messages, and you want to stop only the marketing messages, contact the Business directly, or email hello@dailybuilt.co and tell us which Business you mean.
5.7 If you opt out and later want messages again, you can opt back in by giving the Business your number again, or by replying START or UNSTOP to the same number.
6. How to get help
6.1 Reply HELP to any message for help and for DailyBuilt's contact information. The sending Business is named in every message.
6.2 You can also email hello@dailybuilt.co or contact the Business directly. For questions about your appointment, invoice, document, or the service itself, contact the Business, which is named in every message.
7. Carriers
7.1 Supported carriers include AT&T, Verizon Wireless, T-Mobile, US Cellular, Boost Mobile, Cricket Wireless, Metro by T-Mobile, Google Fi, and most other United States wireless carriers and their resellers. Carrier support may change without notice, and not every carrier supports every kind of message.
7.2 Carriers are not liable for delayed or undelivered messages.
7.3 Message delivery depends on your carrier, your device, your coverage, and factors outside our control. Neither DailyBuilt nor the Business guarantees that any message will be delivered, or delivered on time.
8. We do not sell or share your number for marketing
We do not share or sell mobile phone numbers or SMS consent to third parties or affiliates for their own marketing or promotional purposes.
Your mobile number and your consent are used only to send you the messages described on this page. Your number is shared only with:
- the Business you interacted with, whose messages these are; and
- the telecommunications and messaging providers that deliver the messages on our behalf, solely for that delivery.
Your consent to receive text messages is never transferred, sold, rented, or shared with any other business for that business's own marketing.
9. Privacy
How DailyBuilt collects, uses, and retains your mobile number, your consent record, and message content is described in the DailyBuilt Privacy Policy and, for the DailyBuilt-hosted pages you may have used, the Consumer Privacy Notice. The Business may also have its own privacy policy governing its use of your information.
10. Eligibility
10.1 You must be at least 18 years old, or have the consent of a parent or legal guardian, to enroll a mobile number in this program.
10.2 Enroll only a number you control. By providing a mobile number, you represent that the number is yours or that you are authorized by the subscriber and the customary user of that number to enroll it.
10.3 Tell us if your number changes. If you give up, transfer, or change a mobile number you enrolled, notify the Business promptly so that messages are not sent to the number's new holder. If you receive messages intended for someone else, reply STOP and, if you can, tell us at hello@dailybuilt.co.
11. What these messages are not
11.1 Not for emergencies. Do not use text messaging to report an emergency or an urgent medical, safety, or clinical concern. Call 911 or your local emergency number, or contact the Business by telephone.
11.2 Health-related messages are limited. Where the Business is a healthcare provider, appointment messages are limited to scheduling logistics such as the Business's name, the date, the time, and the location. They are not a secure channel and are not intended to carry clinical information. SMS is not encrypted in transit end to end, and messages remain visible on your device to anyone who can see it. Do not send clinical details, test results, or other sensitive health information by text. Contact the Business for a secure channel.
11.3 Not advice. A message about a booking, a document, or an invoice is not medical, legal, tax, or financial advice.
12. Terms that apply to these messages
12.1 Your use of DailyBuilt-hosted pages and your receipt of these messages are governed by the DailyBuilt End User Terms, which include a binding individual arbitration provision, a waiver of class, collective, and representative actions, and a jury-trial waiver, together with a 30-day opt-out right and a small-claims carve-out. Please read them.
12.2 The Business's own terms may also apply to the underlying appointment, document, invoice, or service.
12.3 If any provision of these SMS Program Terms is held unenforceable, the rest remains in effect.
13. Changes to these Terms
13.1 We may update these SMS Program Terms. The current version is always at https://dailybuilt.co/sms-terms with the effective date at the top. These SMS Program Terms are incorporated into the Terms of Service; a change that materially and adversely affects Customer's rights or obligations is made under Section 20 of the Terms of Service, including its thirty (30) day advance notice by email and in-product notice and Customer's termination remedy in Section 20.4. Prior versions of this document are archived by date and are available on request to hello@dailybuilt.co.
13.2 Continuing to receive messages after an update means the updated terms apply. You can stop at any time under Section 5.
