dailybuilt hosts material its customers create and publish. This policy names our designated agent, sets out what a valid notification must contain, and explains what happens after one arrives.
DailyBuilt, Inc., a Delaware corporation ("DailyBuilt", "we", "us"), hosts material that its business customers ("Customers") and their authorized users create, upload, and publish through the DailyBuilt platform. DailyBuilt respects the intellectual property rights of others and responds to notices of claimed copyright infringement under the Digital Millennium Copyright Act, 17 U.S.C. § 512. This Policy explains how to send a notification, what DailyBuilt does when it receives one, and how the affected user may respond.
1. What this Policy covers
1.1 This Policy applies to material stored on DailyBuilt systems at the direction of a Customer or a person using a Customer's workspace, including: booking pages hosted on a Customer's DailyBuilt subdomain or connected custom domain; documents, files, and images uploaded to a workspace; logos and other brand assets; the text of invoices, quotes, documents, and templates; email and campaign content; and advertising creative composed in the Service.
1.2 As between DailyBuilt and its Customers, the Customer owns and is solely responsible for that material. DailyBuilt does not create it, does not select it, and does not monitor it. See Section 9 of the Acceptable Use Policy.
1.3 This Policy does not cover DailyBuilt's own marketing site, product interface, documentation, or brand assets; send those complaints to hello@dailybuilt.co. Advertising creative that has been published to Meta, Google, or another advertising platform is also hosted by that platform. DailyBuilt can act only on the copy stored in the Customer's workspace and on the Customer's ability to publish further; a notification to the platform is a separate matter for the platform's own process.
2. Designated agent
Send notifications of claimed infringement to DailyBuilt's designated agent:

2.1 Notifications sent to any other DailyBuilt address, or to an individual employee, may not be effective and may not start the timelines in this Policy. Email is the preferred method.
3. What a valid notification must contain
Under 17 U.S.C. § 512(c)(3)(A), a written notification must include substantially all of the following:
(a) a physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed;
(b) identification of the copyrighted work claimed to have been infringed, or, if multiple works at a single online site are covered by a single notification, a representative list of those works;
(c) identification of the material claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit DailyBuilt to locate that material — for hosted material, give the full URL of each page, and for an uploaded file, document, or image, identify it precisely enough that DailyBuilt can find it without judgment;
(d) information reasonably sufficient to permit DailyBuilt to contact you, including your name, mailing address, telephone number, and email address;
(e) a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
(f) a statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
3.1 A notification that does not substantially comply with (a) through (f) may not be effective. DailyBuilt may, but is not required to, contact you to request the missing information.
3.2 Before sending, please consider whether the use is licensed or is a fair use. See 17 U.S.C. § 107.
4. What DailyBuilt does when it receives a notification
4.1 On receipt of a notification that substantially complies with Section 3, DailyBuilt will expeditiously remove, or disable access to, the material identified. DailyBuilt may take down the specific page, file, document, image, template, or message, and where the material cannot be isolated, may disable the surface that contains it.
4.2 DailyBuilt will take reasonable steps to notify the affected Customer or user promptly that material has been removed or disabled, and will forward a copy of the notification. That copy includes the identity and contact information you provided, and DailyBuilt may also provide it to the affected user's counsel or in response to legal process. Send only information you are willing to have disclosed to the person who posted the material.
4.3 DailyBuilt may in addition act under Section 15 of the Acceptable Use Policy, including suspending a feature, a workspace, or an account, where the circumstances warrant it. Fees continue to accrue during a suspension caused by a violation, and no credit or refund is due for that period.
4.4 Where the material is or contains Protected Health Information, DailyBuilt will handle removal, retention, and any disclosure consistently with the applicable Business Associate Agreement and with 45 C.F.R. Part 164.
4.5 DailyBuilt records each notification and each resulting action for the purposes of Section 6.
4.6 DailyBuilt does not adjudicate ownership, licensing, or fair use, and does not undertake to monitor Customer content. Acting or declining to act in any instance does not waive any right, and is not an admission or a finding about any claim.
5. Counter-notification
5.1 If your material was removed or disabled and you believe that was the result of mistake or misidentification, you may send a counter-notification to the designated agent in Section 2.
5.2 Under 17 U.S.C. § 512(g)(3), a counter-notification must include substantially all of the following:
(a) your physical or electronic signature;
(b) identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled;
(c) a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material; and
(d) your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which DailyBuilt may be found), and that you will accept service of process from the person who provided the notification under Section 3 or from an agent of that person.
5.3 On receipt of a compliant counter-notification, DailyBuilt will promptly provide a copy to the person who sent the original notification, including your name and contact information, and will tell that person that DailyBuilt will replace the removed material or cease disabling access to it in not less than ten (10) and not more than fourteen (14) business days.
5.4 DailyBuilt will restore the material within that window unless DailyBuilt first receives notice from the person who sent the original notification that they have filed an action seeking a court order to restrain the infringing activity relating to that material on DailyBuilt's systems.
5.5 Restoration under this Section is limited to the copyright claim. DailyBuilt may keep material down, and may keep a feature or account suspended, where the material independently violates the Acceptable Use Policy, another provision of the Agreement, applicable law, or a vendor requirement, or where a court order, subpoena, or other legal demand requires it.
6. Repeat infringers
6.1 In accordance with 17 U.S.C. § 512(i), DailyBuilt has adopted and reasonably implements, and will inform Customers and Authorized Users of, a policy providing for the termination in appropriate circumstances of the accounts of subscribers and account holders who are repeat infringers.
6.2 DailyBuilt records a strike against a workspace when material is removed or disabled in response to an effective notification under Section 3, other than where the material is restored under Section 5.4 or the notification is withdrawn. DailyBuilt maintains the strike record for at least three years.
6.3 DailyBuilt terminates a workspace, an account, or an Authorized User's access in appropriate circumstances where the record shows repeat infringement. Whether circumstances are appropriate is determined case by case on the record DailyBuilt maintains under Section 6.2, taking into account factors including the number and spacing of strikes, whether the same material or the same rights holder is involved more than once, whether the conduct is commercial in scale, whether it is willful or evasive — including reposting removed material or moving it to another page, domain, workspace, or account — whether counter-notifications were filed, and whether the account holder took corrective action. DailyBuilt does not commit to any particular number of strikes before termination, and may terminate on a first strike where the conduct is egregious.
6.4 Termination under this Section is a termination for cause under the Terms of Service. Amounts already paid are not refundable, and the Customer's booking, signing, payment, and other hosted pages will stop working. The Customer is responsible for communicating with the people it serves about the resulting disruption. DailyBuilt exercises judgment under this Section and is not required to disclose the internal record other than as required by law.
7. Misrepresentation
7.1 Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, is liable for damages — including costs and attorneys' fees — incurred by the alleged infringer, by any copyright owner or its licensee, or by DailyBuilt as a service provider, as the result of DailyBuilt relying on the misrepresentation.
7.2 Do not use this process to resolve a contract, payment, employment, or business dispute, to suppress criticism or a review, or to obtain the identity of an anonymous person. DailyBuilt may decline to act on a notification it reasonably believes is abusive or sent in bad faith, and may report the conduct.
8. Complaints that are not copyright complaints
8.1 Send trademark, right-of-publicity, defamation, privacy, impersonation, and other non-copyright complaints to hello@dailybuilt.co with the URL or identifier, a description of the right claimed, and your contact information. Those complaints are handled under the Acceptable Use Policy and the Terms of Service, not under this Policy, and the timelines in Sections 4 and 5 do not apply to them.
8.2 Requests concerning personal information should follow the Privacy Policy or, for a person who used a booking, signing, or payment page, the Consumer Privacy Notice.
8.3 This Policy describes a United States statutory process. DailyBuilt will also consider notices concerning rights arising under other law, but its response to those notices is governed by the Acceptable Use Policy and the Terms of Service rather than by 17 U.S.C. § 512.

DailyBuilt may update this Policy and will post the updated version at https://dailybuilt.co/dmca with a revised effective date. Prior versions of this document are archived by date and are available on request to hello@dailybuilt.co.
